ARTICLE 1 - CONDITIONS OF USE                                                                                                                                                                         General Terms and Conditions of Sale (from now on referred to as ‘GTCS’) apply, without restriction or reservation, to all sales concluded by the Seller with non-professional purchasers (‘the Customer’) wishing to acquire the products offered for sale (‘the Products’) by the Seller on the https://www.kristinestattin.com website. 

         

By using this website, you certify that you have read and reviewed this Agreement and that you agree to comply with its terms. If you do not want to be bound by the terms of this Agreement, you are advised to stop using the website accordingly. Kristine Stattin only grants use and access to this website, its products, and its services to those who have accepted its terms.

 

The Products offered for sale on this site are as follows: original textile artwork, art greeting cards, and prints of original artwork made by Kristine Stattin.

The main characteristics of the Products, concerning size, techniques, and any other relative descriptions, are presented on the site https://www.kristinestattin.com, which the Customer is required to read before ordering. The choice and purchase of a Product are the Customer's sole responsibility. Product offers are subject to availability, as specified when the order is placed.

 

These GTCS are always accessible on the https://www.kristinestattin.com website and shall prevail over any other documents. The Customer declares that he/she has read these GTCS and has accepted them by ticking the box provided for this purpose before completing the online ordering procedure on the https://www.kristinestattin.com website. Unless there is proof to the contrary, the data recorded in the Seller's computer system shall constitute proof of the sale of the Products.

The Products presented on the https://www.kristinestattin.com website are offered for sale in the following territories: Europe, the United States, Canada, Australia, New Zealand, and Great Britain. If you live in another part of the world other than those stated, don't hesitate to contact the Seller via Email. In the event of an order to a country other than mainland France, the Customer is the importer of the Product(s) concerned. For all Products dispatched outside the European Union and French overseas departments and territories, the price will automatically be calculated exclusive of tax on the invoice.

ARTICLE 2 - AGE RESTRICTION

You must be at least 18 (eighteen) years of age before you can use this website. By using the website, you warrant that you are at least 18 years of age and that you may legally adhere to this Agreement. Kristine Stattin assumes no responsibility for liabilities related to age misrepresentation.

ARTICLE 3 -  PRODUCTS

The products are all made by hand by Kristine Stattin, except for the prints of original work. Each piece is unique, and there will never be two of the same piece.  The photographs of the products shown are of the actual product. There may be variations in colour and appearance depending on different computer screens. Kristine Stattin cannot be held responsible for any errors that do not affect the substantial characteristics of the products.

ARTICLE 4 - PRICES                                                                                                                                                                                              The Products are supplied at the current prices shown on the https://www.kristinestattin.com website, at the time the order is registered by the Seller. Prices are expressed in Euros, exclusive of VAT. Prices take into account any discounts that may be granted by the Seller on the https://www.kristinestattin.com website. These prices are firm and non-revisable during their period of validity, but the Seller reserves the right, outside their period of validity, to modify the prices at any time. Prices do not include delivery charges, unless so stated, which are invoiced in addition, under the conditions indicated on the site and calculated before the order is placed. The payment requested from the Customer corresponds to the total amount of the purchase, including these charges. An invoice is drawn up by the Seller and given to the Customer upon delivery of the Products ordered.

Eventual customs duties, other local taxes, import duties, or state taxes may be payable. The Customer shall be solely liable for any such charges.

ARTICLE 5 - ORDERING    

It is the Customer's responsibility to select the Products they wish to order on the https://www.kristinestattin.com site. Product offers are valid as long as they are visible on the site, within the limit of available stocks. The sale will only be considered valid after full payment of the price. It is the Customer's responsibility to check the accuracy of the order and to report any errors immediately. Any order placed on the https://www.kristinestattin.com site constitutes the formation of a contract concluded remotely between the Customer and the Seller. The Vendor reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order.  

 

ARTICLE 6 - TERMS OF PAYMENT                                                                                                                                                                   The price is paid by secure payment by credit card. The price is payable in full by the Customer on the day the order is placed. Payment data is exchanged in encrypted mode using the protocol defined by the approved payment service provider involved in banking transactions carried out on the website https://www. kristinestattin.com.

The website is using Stripe and PayPal for all transactions.

The Seller shall not be obliged to deliver the Products ordered by the Customer if the Customer does not pay the Seller the full price in accordance with the aforementioned conditions.

ARTICLE 7– DELIVERIES    

Deliveries are made by Colissimo to the address given by the Customer when the order was placed. The Products ordered by the Customer will be delivered in mainland France or in the following zone(s): European Union, United States, Canada, Great Britain, Australia, and New Zealand.

Allow up to four working days to prepare and ship the order.           

Orders over 50€ will automatically be shipped on a tracked and/ or signed service.                                                                      

Delivery times depend on the destination and the shipping services to the address indicated by the Customer when placing the order on the site.

 

Delivery is constituted by the transfer to the Customer of physical possession. When the Customer has arranged for a carrier of his own choosing, delivery is deemed to have taken place as soon as the Products ordered have been handed over by the Seller to the carrier, who has accepted them without reservation. The Customer therefore acknowledges that it is the carrier´s responsibility to make the delivery and has no recourse against the Seller in the event of failure to deliver the goods transported.                                                                                                                                                     

In the event of a specific request from the Customer concerning the conditions of packaging or transport of the products ordered, duly accepted in writing by the Seller, the related costs will be subject to specific additional invoicing, based on an estimate previously accepted in writing by the Customer.                       

                                                                                           

The Customer is obliged to check the condition of the products delivered and has 14 days from the date of delivery to make any complaints by e-mail to kristinestattin@gmail.com accompanied by all relevant supporting documents (in particular photographs). Once this period has elapsed and if these formalities have not been complied with, the Products will be deemed to be in conformity and free from any apparent defect and no complaint will be validly accepted by the Seller.

The Seller will reimburse or replace, as soon as possible and at his own expense, the Products delivered for which the defects in conformity or the apparent or hidden defects have been duly proven by the Customer, under the conditions set out in Articles L 217-4 et seq. of the French Consumer Code and those set out in these GTCS. The transfer of the risks of loss and deterioration relating thereto will only take place when the Customer takes physical possession of the Products. The Products therefore travel at the Seller's risk, except where the Customer has chosen the carrier. In this respect, the risks are transferred when the goods are handed over to the carrier. 

                                                                                                                                                                                                                          ARTICLE 8- TRANSFER OF OWNERSHIP                                                                                                                                                             The transfer of ownership of the Products from the Vendor to the Customer will only take place once the latter has paid the price in full, regardless of the date of delivery of said Products.

ARTICLE 9 - RETURNS                                                                                                                                                                                         In accordance with Article L221-18 of the French Consumer Code, ‘For contracts providing for the regular delivery of goods during a defined period, the period runs from receipt of the first good. ‘

The right of withdrawal may be exercised simply by writing an email to kristinestattin@gmail.com  Returns must be made in their original condition and complete (packaging, accessories, instructions, etc.) to enable them to be re-marketed as new, accompanied by the purchase invoice. Damaged, soiled or incomplete Products will not be taken back.

The cost of returning the Products will be held by the Customer.

The refund, except initial delivery charges, will be made within 14 days of receipt by the Seller of the Products returned by the Customer under the conditions set out in this article.                                                                                                                                                                                            

ARTICLE 10 - RESPONSABILITY

Kristine Stattin shall not be held liable for any damage inherent in the use of the Internet network, such as loss of data, computer viruses, intrusion and breakdown in service.

With regard to the products offered, Kristine Stattin cannot be held responsible for any damage resulting from improper use, such as machine washing, use of any household products, etc.

ARTICLE 11 - PERSONAL DATA                                                                                                                                                                         The Customer is hereby informed that the collection of his/her personal data is necessary for the sale of Products by the Seller and for the transmission of such data to third parties for the purposes of delivery of the Products. This personal data is collected solely for the performance of the sales contract.                                                                                                                   

11.1 COLLECTION OF PERSONAL DATA. The personal data collected on the https://www.kristinestattin.com website is as follows: Ordering Products: When the Customer orders Products: Name, first name, postal address, telephone number and e-mail address.

Payment: The https://www.kristinestattin.com website, does not collect and record any of the Customer´s financial data. All transactions are made via Stripe or PayPal.                                                                                                                                   

11.2 RECIPIENTS OF PERSONAL DATA  Personal data is used by the Seller and its co-contractors for the performance of the contract and to ensure the efficient sale and delivery of the Products. The category(ies) of co-contractor(s) is (are):

Transport service providers: Colissimo.  

Payment institution service providers: Stripe, PayPal.                                                                                                                               

11.3 DATA CONTROLLER The data controller is the Seller, within the meaning of the French Data Protection Act and, as of 25 May 2018, Regulation 2016/679 on the protection of personal data.                                                                                                               11.4 LIMITATION OF PROCESSING Unless the Customer expressly agrees, his or her personal data will not be used for advertising or marketing purposes.                                                                                                                                                                                   11.5 DATA RETENTION PERIOD The Seller will retain the data thus collected for a period of 5 years, covering the period of limitation of the applicable contractual civil liability.                                                                                                                                11.6 SECURITY AND CONFIDENTIALITY The Seller implements organisational, technical, software and physical digital security measures to protect personal data against alteration, destruction and unauthorised access. However, it should be noted that the Internet is not a completely secure environment and the Seller cannot guarantee the security of the transmission or storage of information on the Internet.   

11.7 IMPLEMENTATION OF THE RIGHTS OF CUSTOMERS AND USERS In application of the regulations applicable to personal data, Customers and users of the https://www.kristinestattin.com site have the following rights:

They may update or delete the data concerning them in the following way:

By writing to Kristine Stattin by e-mail kristinestattin@gmail.com or through the contact form on the website.

.- They may delete their account by writing to the e-mail address indicated above.

- They may exercise their right of access to the personal data concerning them by writing to the e-mail address indicated above.

- If the personal data held by the Seller is inaccurate, they may request that the information be updated by writing to the address kristinestattin@gmail.com  They may also request the portability of data held by the Seller to another service provider.

- Finally, they may object to the processing of their data by the Seller. These rights, provided that they do not conflict with the purpose of the processing, may be exercised by sending a request by post or e-mail to the Data Controller, whose contact details are given above. The Data Controller must provide a response within a maximum of one month. If the Customer's request is refused, reasons must be given. The Customer is informed that in the event of refusal, he/she may lodge a complaint with the CNIL (3 place de Fontenoy, 75007 PARIS) or refer the matter to a judicial authority.

The Customer may be asked to tick a box under which he/she agrees to receive informative and advertising e-mails from the Seller. He/she will always have the option of withdrawing his/her agreement at any time by contacting the Seller  (contact details above) or by following the unsubscribe link.     

                                                                                                                                                                                                                        ARTICLE 12 – INTELLECTUAL PROPERTY                                                                                                                                                            The content of the https://www.kristinestattin.com website is the property of the Seller and its partners and is protected by French and International laws relating to intellectual property. Any reproduction, in whole or in part and any redistribution of this content is strictly prohibited and may constitute an infringement of copyright.

ARTICLE 13 – DISPUTES                                                                                                                                                                                     For any complaint, please contact Kristine Stattin at the e-mail address indicated in ARTICLE 1 of these GTCS.                                 These terms and conditions of sale are governed by French law.

Any claims will be resolved amicably.

In the event of a dispute and in the absence of an amicable solution, the French courts shall have sole jurisdiction.

ARTICLE 14 - INDEMNIFICATION

You agree to indemnify Kristine Stattin and its affiliates and hold Kristine Stattin harmless against legal claims and demands that may arise from your use or misuse of our services. We reserve the right to select our own legal counsel.

ARTICLE 15 - LIMITATION ON LIABILITY

Kristine Stattin is not liable for any damages that may occur to you as a result of your misuse of our website.                                Kristine Stattin reserves the right to edit, modify, and change this Agreement at any time. We strongly urge the Customer to revise this Agreement before any use of the website.

This Agreement is an understanding between Kristine Stattin and the Customer, and this supersedes and replaces all prior agreements regarding the use of this website.
